I'm concerned about the Copyright Issues - the concept of "Abandonedware" has been proven to be fasle, so I'm wondering how these people are getting around the copyright - or are they just ignoring it?

In most places, copyright enforcement has to proceed only after a cease and desist has been delivered (you have to actively protect your copyrights). If the owner does not contact them to prohibit it, it's unlikely to proceed any further, litigation-wise.
