When playing and using the rule set, if a character has a attack skill of 97% and rolls a 96% for an attack it denotes it as a failure. But the weapon is a longsword and has no malfunction. I cannot find any rule for auto failure in BRP. Is this a bug? Or am I missing something in the rules?

You always hit on a 1-5 and miss on a 96-00 in BRP.

Do you know where in the book I can find that rule. I have not been able to locate it. And does that apply only to attack, or is all skills?

On page 193 of the BGB for combat skills and page 173 for all skills.

A result of the highest 1/20 the chance of failure, usually ranging from 96-100 for lower skill levels to a roll of 100 for when character skill levels are over 100%.

If that is the result it is giving, then it is wrong. A roll of 98, 99 are misses and a 00 would be a Fumble. All skills work this way. This ruleset has been tested but it is only as good as the feed back and bugs fixed. It needs some work, and there is some talk about doing work on the whole of the d100 rulesets. **** corrected in a later post

With skill level a 97%.. only a roll of 00 will be a fumble.

The 1-5 hit and 96-00 miss have always been part of BRP... sorry I can't quote the page. 97 is a miss even if you have a 97 skill. There is always a 5% chance to miss and hit.

Page 19 of Chaosium's RQ2 1979. Lots has changed since then. :D Computers and the internet for instance...

But page 173 of BGB does state under the Failure heading: action rolls fail on results of 96 or higher
so if you have a skill rating of higher than 95% you still only have a 95% chance to hit. Very similar to DnD where a natural 1 is always a failure.

as a side note: on page 170 it says if you have a skill of 5% or more you will always have at least a 5% chance to succeed no matter how low the modified chance is.
